Deadlines- listed above are the last day a case can be added to a docket and include all matters except substantive motions.

Motions- No later than 14 days before the day the matter is set for hearing, criminal motions, not already set by the court, must be filed, and served with a docket notice that sets the hearing on a criminal motion docket.  Responsive pleadings must be filed and served no later than 7 days before the hearing date.   All motions shall be scheduled before the scheduled trial date.  Any motion that is filed with insufficient time to comply with these requirements must be accompanied by a motion for an order shortening time and a proposed order that allows the matter to be set prior to the trial date.

Motions must be confirmed with Superior Court Administration no later than five (5) court days prior to the scheduled hearing.

Defense groups- For scheduling purposes only, a mix of contract attorneys and staff attorneys for the Cowlitz County Office of Public Defense are assigned as follows:

Defense 1                          Defense 2                          Defense 3                          Defense 4

Dan Morgan                       Joshua Gooday                Quincy Frazier                 CeCelia Andrew

Max Lee                              Ted DeBray                        David Phelan                    Diane Sweet

Matthew Morrison         Ian Maher                           Stephen Geiger

Elliot Yug

Contract Defense Attorneys- Once the court determines that a defendant is indigent, the Office of Public Defense (OPD) is responsible for the appointment of a specific attorney to each case.  There is a need to appoint attorneys who do not work in that office to handle cases that present a conflict of interest for OPD and to have enough attorneys available to handle the volume of criminal cases.  The following attorneys handle as court appointed cases:

Morgan Law Firm, Dan Morgan and Max Lee, 1555 3rd Ave, Suite A, Longview WA 98632 (360) 425 3091

Ted Debray 1338 Commerce Ave, Suite 101 Longview WA 98632 (360) 559 1572

Josh Gooday 1338 Commerce Ave, Suite 101 Longview WA 98632 (564) 217 3219

If you have been appointed a lawyer, you must maintain good contact with that lawyer.  If you do not recall which lawyer was appointed to represent you, call the Office of Public Defense at (360) 578 7430 and ask their office staff to provide that information.

Private attorneys may schedule hearings during any of the six dockets assigned to a defense group; motions must be set on one of the two motion calendars.

Jury trials commence Tuesday-Friday and may resume Monday if they move into a second week.   Jury books are emailed to the attorneys the day prior to trial.
